We are recruiting for an Employee Investigations and Resolutions Lead, who will be responsible for the delivery of our new centralised Investigations and Resolutions Service. 

Main duties of the job

The postholder is responsible for ensuring a fit for purpose, agile, high performing and results orientated Employee Investigations and Resolutions service, aligned to the trust’s strategic aims, including, equality diversity and inclusion, Just and Restorative culture and Trust values and behaviours framework.

The postholder will manager and lead the Investigations and Resolution Team, ensuring timely and efficient resolution to employee concerns and ensure HR Investigations are completed to a high standard in a timely manner and that systems are in place to mitigate risks and delays.

Detailed job description and main responsibilities

Managing communication with colleagues at all levels of the organisation in dealing with highly Complex and sensitive issues

Provide expert advice and support on hearing panels for highly complex cases and appeals, including allegations of discrimination and high-risk cases. 

Working with managers and senior colleagues to fully embed resolution options identified by the Resolution team, resolving issues or resistance with negotiation and persuasive skills

Management of the Triage process for dealing with conduct and grievance issues, ensuring fairness and consistency in the application of formal procedures

Undertake highly complex investigations, where there could be a high risk of legal implications

Providing effective leadership and management to a professional Investigations team, who will provide a range of services to support the Resolution of Conduct and Grievance issues, including formal casework as well as a supporting the implementation of a modernised, person-centred approach to managing conflicts and concerns in the workplace through the introduction of a resolution framework.

Providing complex case advice to senior managers as needed, specifically in the areas of disciplinary, grievances and settlement agreements.

Work in collaboration with the OD function and HRBPs to support the development of the people management capacity of senior and operational managers through the provision of coaching and deliver people related training and facilitation.

Utilise workforce data to identify People strategic and operational support required and work collaboratively with managers and HR Business Partnering teams to ensure that the necessary interventions occur.

Establishing effective networks and partnerships with the HRBP teams to build effective working relationships and enable the delivery of people strategies and plans.

Responsible for reviewing all formal case outcomes ensuring that conclusions are reasonable and consistent with organisational approaches.

Responsible for reviewing recommendations that are made as part of formal outcomes. Ensure that recommendations are recorded and track the progress through to resolution.

Analysing and deciding on the best course of action for complex and specialist ER issues, including discriminatory matters

Develop and lead the strategic plan for ensuring investigations are conducted within the KPIs and implementation of Resolution approach to reduce formal cases

Responsible for development of policies and procedures, designed with the resolution of conduct and grievance issues, incorporating national frameworks and initiatives, new standards and practices to formulate an effective resolution function

Budget responsibility for the Investigations and Resolutions team

Responsibility for designing and providing specialist training to team members to ensure the effective delivery of resolution practices, such as coaching, facilitation, conflict management.

Responsible for ensuring an effective information tracking system for all investigations and resolutions

Interprets employment law to assess the most appropriate course of action for resolving complex conduct and grievance issues, and makes autonomous decisions on specialist matters

Produces high level Reports to the Senior Management Team, using data to identify themes, risk assessment of cases and needed improvements to practice

Leads formal investigation case reviews to embed a continued culture of and learning and development 

Ensure the well-fare of employees and team members, ensuring employees are informed and supported during the investigation process; creating a safe space and de-brief for colleagues involved in complex ER matters

Design and implementation of ER case tracking systems to enable complex reporting on Trust wide case-work for both internal and external oversight.

Maintain consistent and professional negotiations in complex and frequently highly challenging emotional circumstances, ensuring the application of the Trusts’ visions and value in the application of Formal ER procedures supported by the resolutions team.

Provide the Resolutions team with supervision and case guidance in relation to the mediations and facilitation service provision.  Ensuring the wellbeing of the team is regularly monitored and reviewed, placing emphasis on the psychological impact of challenging case management. 

Manage Early conciliation with ACAS and responsible for the coordination of Employment Tribunals linked to Disciplinary or Grievance cases; leading on the collating of cases with external legal teams, providing witness support, attending Tribunal hearings and ensuring communication with senior HR team regarding risk.

Provide People and Culture Business Partnering to the Exec and Corporate functions; including Culture review and implementation and workforce planning

Deputise for the Head of ER & BP.

Qualifications

Essential criteria
  • Currently registered and accredited Chartered Member of the Chartered Institute of Personnel and Development (Chartered MCIPD) or able to evidence having commenced the upgrading process with CIPD or willing to undertake accreditation.
  • Educated to Masters level or equivalent level or equivalent experience of working at a senior level in specialist area.
  • Evidence of continued learning/development and the practical application of this

Experience

Essential criteria
  • Experience of working in a senior operational HR role
  • Significant and recent experience of working with and interpreting employment law
  • Significant experience working with complex Employee Relations Issues, including managing conflict
  • Significant and recent experience undertaking or supporting complex Employee Relations Investigations, including discrimination claims
  • Experience of leading and managing a team
  • Previous experience of designing and delivering specialist training programmes
